§ 12-7. Right to appeal notice.

  • Any owner aggrieved by the findings and order of the code enforcement officer as set forth in section 12-4 shall have the right to appeal said decision prior to the expiration of the time within which such owner was given to abate the nuisance. Any appeal taken pursuant to this section must be requested, in writing, and timely received by the city clerk at 451 3rd Street, N.W. In the event the time for owner to abate the nuisance expires on a weekend, evening or a holiday, owner shall have until 5:00 p.m. the next business day to file the request for appeal. Such written notice or request may be in any form which clearly notifies the city of owner's request. The enforcement officer shall place the appeal on the agenda of the next scheduled regular meeting of the section 2-61 special master. Any appeal shall stay all proceedings in furtherance with the action appealed from until after the hearing is held.
