§ 9-303. Requirements.

  • (a)

    Owners of businesses, entertainment facilities, and sponsors of events shall provide for private security services at the premises of the business, entertainment facility, or event during all hours of business and/or operation when: The Chief of Police of the City of Winter Haven has verified and documented three (3) separate instances, on three (3) different dates, during any thirty-day period, or; six (6) separate instances during any ninety-day period, the existence of nuisance and/or illegal conduct on the premises of said privately operated business, entertainment facility, or event, where such conduct is found to arise out of the operation of such business, entertainment facility, or event or that such business, entertainment facility, or event materially and substantially contributed to or was conducive to maintaining said nuisance and/or illegal conduct, or; it is reasonably foreseeable that such nuisance and/or illegal conduct, as described above, will occur and arise out of the operation of such business, entertainment facility, or event.

    (b)

    Private security services, as shall be required in paragraph (a) above, shall include a sufficient number of private security personnel, licensed under state law or off duty law enforcement officers, to ensure that nuisance and/or illegal conduct does not occur on the premises of the business, entertainment facility, or event during business hours. Should such nuisance and/or illegal conduct continue to occur on the premises while security personnel are present, such occurrence shall be prima facie evidence that the number of security personnel provided is insufficient and an additional number of security personnel shall be required.
