§ 1-15. Prosecution of indigents; authorization to contract for legal services.

  • To the extent that the city is required by law to pay for the criminal defense of indigent persons charged solely with a city ordinance violation, the penalty for which may actually include imprisonment, the city shall, through its police department, enter into contractual arrangements with attorneys licensed by and in good standing with the Florida Bar for the court-appointed representation of such persons and make those contractual arrangements and the terms thereof known to the administrative judge of the county court in and for Polk County, Florida. Only those persons qualifying as indigent under F.S. § 27.52 shall qualify for the court-appointed services of a contract attorney pursuant to this section. In the event that an order of no imprisonment is entered in a prosecution pursuant to F.S. § 27.512, the court shall immediately terminate the services of any attorney appointed by the court pursuant to this section.
