§ 19-151. Industrial wastewater.

  • (a)

    Definition. This service is defined as liquid waste from manufacturing processes, trades, businesses or practices as distinguished from ordinary, normal and usual sanitary sewage regardless of its source. This service shall also include any large institutional user. This service shall include any supply of sewage placed into the sanitary sewer system which, in the opinion of the city's professional consulting engineers, constitutes a special problem either because of its strength, quantity, nature of waste or resulting problems of the city's sanitary sewer system.

    (b)

    Rate determination. The following items shall make up the rate schedule:

    (1)

    Metering charge. Where the user purchases all water required from the city and all water purchased is discharged to the city sanitary sewer system, the water meter, or meters, shall be used as a basis of determining quantity of waste. No metering charge would be made in this case. Where special metering is required, the cost of such metering shall be determined by the city and become a part of the rate to be applied monthly, the cost to install special metering devices and structures will become a part of the initial connection charge. Where standard water meters are applicable, the meter charges which shall be made are on file in the city clerk's office.

    (2)

    Laboratory charge. The laboratory charge is comprised of costs for analyzing samples. A schedule of charges is on file in the city clerk's office.

    (3)

    Collection charge. A monthly charge for collecting wastewater is on file in the city clerk's office.

    (4)

    Treatment charge. The monthly charge for treating standard wastewater will be computed on the basis of hydraulic flow and constituent strength which is on file in the city clerk's office at 451 Third Street, N.W. Winter Haven, FL.

    (5)

    Penalty charge. A penalty charge of not less than one-half of the average monthly billing will be imposed on the user for allowing constituents of wastewater to exceed the allowable limits defined in the "industrial wastewater limitations table" incorporated by reference and adopted herein on file in the city clerk's office at 451 Third Street, N.W. Winter Haven, FL. Continued violation shall be considered grounds for the city to refuse to accept the waste.

    (6)

    Initial connection charge. The initial connection charge shall be in accordance with adopted policy of the city where applicable; otherwise, the connection charge shall be as mutually agreed upon between the city and the customer.

    (7)

    Minimum charge. For industries which do not operate year-round, a minimum charge of seventy (70) percent of the average monthly charge shall be assessed for those months in which the industry does not operate and does not produce industrial wastewater.

    (8)

    [ Local limits. ] No person shall discharge wastewater containing pollutants in excess of the industrial wastewater limitations, known as local limits, for those pollutants which have been established for the city's POTW using standard procedures, calculations and methods acceptable to FDEP to protect against pass through, interference, protection of POTW employees, and adverse affects on wastewater residuals disposal. No industrial user shall discharge process waste streams, unregulated waste streams, or dilute waste streams in excess of concentrations set forth by the utility/engineering services department director. Local limits shall be included as permit conditions and attached to each SIU wastewater permit issued.

    The established local limits are subject to change and shall be modified as needed based on regulatory requirements and standards. POTW operation, performance and processes, the industrial user base, potable water quality and domestic wastewater characteristics. Modifications to the established local limits must be reviewed and approved by FDEP prior to implementation. Implementation shall be effective thirty (30) days from notice of acceptance of the modified limits by FDEP. Permitted SIUs shall also be issued an addendum to their wastewater discharge permit containing the new local limits.

    The established local limits apply at the point where the wastewater is discharged to the POTW. All concentrations for metallic substances are for total metal unless indicated otherwise. At his or her discretion, the utility/engineering services department director may impose mass limitations in addition to or in place of the concentration-based limitations.
