§ 2-147. Vacancy in candidacy.

  • (a)

    In the event a vacancy in a commission candidacy occurs because a death, withdrawal, or removal from the ballot of a qualified candidate following the end of the qualifying period and such vacancy leaves fewer than two (2) candidates for an office, the following shall occur:

    (1)

    If only one (1) qualified candidate remains on the ballot, and in the absence of a qualified write-in candidate for that office, then that candidate shall be deemed elected.

    (2)

    If no qualified candidates remain, a special election shall be called and held as soon as practicable, following such vacancy, to fill the commission seat. Alternatively, pursuant to this subparagraph (b), a new qualifying period may be established for the scheduled election to fill the commission seat, if such is practically feasible and same is approved and acceptable to the Polk County Supervisor of Elections.

    (3)

    The name of any qualified candidate who has withdrawn, died or been removed from the ballot shall not be printed on the ballot. If the ballot cannot be changed, any votes for that candidate shall be null and void.

    (4)

    A candidate withdrawing or being removed from the ballot after having qualified and paid the qualification fee shall not receive refund of the qualifying fee.
