§ 2-145. Manner and method of elections.

  • Regular municipal elections shall be held every odd numbered year and, in the event the candidate for city commission does not receive a majority vote, then a runoff election shall be held on the first Tuesday in December in odd-numbered years. The names of the candidates placing first and second for each commission seat in the regular municipal election shall be placed on the ballot in the runoff election in all contests wherein no candidate received a majority of the votes cast in the regular municipal election; except, in contests where there is a tie for first place in the regular municipal election, only the names of the candidates so tying shall be placed on the ballot in the runoff election and in all contests wherein there is a tie for a second place in the regular municipal election and the candidate placing first did not receive a majority of the votes cast, then in that event only the names of the candidates placing first and tying for second shall be placed on the ballot in the runoff election. The candidate receiving a plurality of votes shall be declared elected. A notice of the calling and the holding of any election shall be published once in a newspaper of general circulation in the city at least thirty (30) days before the date upon which said election shall be held. Electors of the city shall have the same qualifications to be permitted to vote in any city election as electors of the state elections and shall be registered with the supervisor of elections of Polk County, provided that no capitation or poll tax payments shall be a prerequisite to the qualifications of an elector of said city. The city commission shall by ordinance prescribe the manner and method of holding all special elections in said city which are not provided for by the terms of the city Charter, and shall in such ordinance prescribe when and how such special election shall be called and held. All elections shall be substantially on the principles adopted for state elections, insofar as there is not conflict with the terms of the city Charter; provided, that the city commission may, by ordinance, prescribe the manner, method and conduct of elections not in conflict with the city Charter.
