§ 19-156. Payment of certain utility fees over time—Generally.

  • The city may allow certain property owners to pay city water and wastewater expansion fees over time, with interest, when all of the following conditions are met:

    (1)

    A governmental authority, having jurisdiction over the property, has mandated that the applicant is legally required to take the action which would result in the payment of the fees.

    (2)

    An application for installment payments shall be submitted by the owner of the property to which the fee is applicable.

    (3)

    The applicant shall show that payment in full of water and/or wastewater expansion fees would create an undue financial hardship on the property owner; said hardship being unique to the owner and not self created. Evidence may include, but not necessarily be limited to, financial statements, evidence of denial of financing by private lenders, etc.

    (4)

    The applicant shall show that connection to the utility system would benefit the citizens of the city and the existing customers of the utility system. Such evidence may include, but not necessarily be limited to, elimination of a known source of pollution, elimination of a known health hazard, assurances that fee payment and utility charges will be paid, etc.
