§ 19-15. Trees—Planting restrictions.

  • It shall be unlawful for the owner or occupant of any lot, parcel, or piece of land within the city to plant or cause to be planted any overstory tree within twelve (12) horizontal feet of any public underground or overhead utility line, to include, but not [be] limited to, water, sewer, refuse, electric, communication, and gas, within the city's utility service area. In the event that the planting of an overstory tree is required by other applicable provisions of the City's Code of Ordinances and/or Unified Land Development Code (ULDC) and cannot be located outside of twelve (12) horizontal feet of any public underground or overhead utility line on a single-family lot due to the lot size and shape, or lot improvements, or other planting restrictions, then the city's growth management director may reduce the distance to no less than eight (8) horizontal feet upon a written application of an owner or occupant of any lot, parcel or piece of land within the city. Any reduction authorized hereunder by the growth management director shall only be the minimum amount necessary in order to meet compliance with this and other applicable Code and/or ULDC requirements. The growth management director's decision shall be final. A list of typical overstory trees can be found in the city's landscape ordinance, a copy of which is on file with the city's planning division and can also be found on the city's website.
