§ 18-101. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Bicycle means every vehicle propelled solely by human power, and every motorized bicycle propelled by a combination of human power and an electric helper motor capable of propelling the vehicle at a speed of not more than twenty (20) miles per hour on level ground upon which any person may ride, and any wheeled electric and/or motorized vehicle whose top speed is not greater than twenty-five (25) miles per hour, and including any device generally recognized as a bicycle though equipped with any number of wheels, except for medical devices commonly known or referred to as wheelchairs, regardless of form. No person under the age of sixteen (16) may operate or ride upon a motorized bicycle.

    Bicycle path means designated lanes or sidewalks where bicycles share way with pedestrians.

    Bicycle route means designated streets where bicycles share street with other vehicular traffic.

    Business district means the territory contiguous to, and including, a highway when fifty (50) percent or more of the frontage thereon, for a distance of three hundred (300) feet or more, is occupied by buildings in use for business.

    Crosswalk means:

    (1)

    That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway, measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway;

    (2)

    Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossings by lines or other markings on the surface.

    Daytime means the period from sunrise to sunset.

    Driver means any person who drives or is in actual physical control of a bicycle on a highway or who is exercising control of a bicycle or steering a bicycle.

    Nighttime means the period from sunset to sunrise.

    Road means that part of the trafficway which includes both the roadway and any shoulder alongside the roadway.

    Roadway means that portion of a trafficway which is improved, designed, or ordinarily used for vehicular travel, exclusive of the shoulder. In the event the trafficway includes two (2) or more separate roadways, the term "roadway" refers to any such roadway separately but not to all such roadways collectively.

    Shoulder means that portion of the road adjacent to the roadway, on which motor vehicles may maneuver, but which does not normally permit the vehicular speeds that are possible on the roadway. The shoulder of the road is normally used for emergency parking, travel by pedestrians, farm machinery, or horse-drawn vehicles.

    Sidewalk means either a paved or unpaved walkway intended primarily for pedestrians located on the side and/or abutting any street or highway or in or through a public park or any other property owned or controlled by the City of Winter Haven.

    Street or highway means the entire width between the boundary line of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.

    Trafficway means the entire width between boundary lines of every way or place of which any part is open to the use of the public for purposes of vehicular traffic as a matter of right or custom.
