§ 15-126. City control; City Manager's authority.

  • The following provisions shall apply to all cemeteries operated by the City generally:

    (1)

    Maintenance; landscaping. All grading, landscape work and improvements of any kind, and all care of lots, shall be done; and all trees and shrubs and herbage of any kind shall be planted, trimmed, cut or removed; and all openings and closings of lots, and all interments, disinterments and removals shall be made only by the City. All monuments, markers and monument foundations shall be installed by the City or a person or firm possessing a valid registration with the state to perform such services; and said installation shall be in accordance with the written policies of the City.

    (2)

    Permanent planting and care. Permanent planting of grasses, shrubs, flowers, etc., shall be made by the City and further planting may be permitted only at the discretion of the City Manager. The care of grass, including the seeding, weeding, watering, and mowing shall be done by the City. The care of shrubbery includes the planting, pruning, fertilizing, and replanting. All plantings shall be under the control of the officials of the City. The ownership or right of interment in lots does not confer any right to do planting, etc., without the express approval of the proper officials of the City.

    (3)

    Supervision of lots. The City retains control and supervision of all lots which are sold. The City retains the right to have its City Manager enter upon any lot and prohibit, modify or remove any structure, object, improvement or adornment from such lot, which may have been placed therein in violation of the rules, or which may be considered objectionable, or injurious to the lot, adjoining lots or to the cemeteries in general.

    (4)

    Employees' work and pay. No work may be done upon lots, except by the regular employees of the City, except by permission of the City Manager. No person while employed by the City shall receive any fee, gratuity or commission, except from the City.
